Aerial Combat versus Melee Ground-Based Combat

Hi,

Am I right in thinking that if a group of flying creatures (ie Gargoyles) attacks a group of PC's (non-flying kind!) then the gargoyles could make "charge" attacks via an aerial attack (aka "bombing run" style?)
Using this at a 45 degree angle, on a 10 metre angle would give them a +14 charge bonus to OB
(i.e. Sqrt((102 + 102) )

is that correct?

Also the Gargoyles wouldnt have to do a Dinsengage from Melee as they could make a 5' move UPWARDS thus taking them out of range. Sure the PC's could (technically)get a free hit but they cant reach, so no attack.

Am I missing anything?

Sounds good to me, but I would use easier math (forget about the hypotenuse and square roots)  ;D
A military solution isn't the only answer, just one of the better ones.
